These terms and conditions govern the use of the Clean Ocean application, hereinafter referred to also as “the App” by users.

Contractual party of the user is:

Clean Ocean Society

Hereinafter referred to as “COS”

A non-profit society registered with the Swiss Registry of Societies.

Terms and Conditions for use of the App “Clean Ocean”

These terms and conditions govern the use of the Clean Ocean application, hereinafter referred to also as “the App” by users.

Purpose of COS

COS wants this to be more than just an app, we want this to be an awareness project and to build a community of beach cleaners who want to clean beaches and/or connect those who are already organising clean up events.

This is an app that should allow groups to connect and share details about their events.

The App has an interactive map that will make users able to report and "pin" litter to globally locate littered beaches or areas.

The App allows users to see when and where cleanups are taking place, make others aware of your planned events and make a difference by connecting people, to clean beaches over the whole world.

Using the Clean Ocean App

These Terms and Conditions are binding on any use of the App by the user. By using the Clean Ocean App, the user agrees having read and agrees to be bound by these Terms and Conditions. User is responsible for informing any third party using his devices about these Terms and Conditions.

Registering with Clean Ocean App

When registering on the App, the user will be asked to sign up with a social media account or email account.

Providing data

The user confirms having all rights and consent for disclosing to Clean Ocean any data, including any personal data, submitted while using the Clean Ocean App. Users will be required to provide accurate and complete data regarding themselves, as required in the registration form. The processing of personal data provided by users is governed by the Privacy Policy of the Clean Ocean App, which is available at Privacy Policy (See below).

Data security

The user is responsible for maintaining the confidentiality of his password. The user is responsible for how his account is used. Users understand and agree not to use the account or the password of other users. If you notice any unauthorized use of your account, as well as any violation of the confidentiality of personal data, you are obliged to inform COS who will forward the information to software developers involved in maintaining the App. If the user breaches these Terms and Conditions, COS may, however is not obliged to, limit or block access to a member's account, without prior notice.

Using Clean Ocean App information

Information contained in the Clean Ocean App is intended to be used by users for information and interconnection with other users, or for research purposes and cannot be marketed in any form. Using information from the Clean Ocean App in an illegal or unauthorized way, is strictly prohibited.

Users are solely liable for how they use the information about litter locations provided in the Clean Ocean App, including their activities if they choose to access or remove litter. COS is not liable for the activities of users who access or remove litter. When a litter location is published on the Clean Ocean App, such does not constitute an approval or request by COS to remove the litter. Users acknowledge that accessing litter locations published on the Clean Ocean App may be dangerous and/or illegal.

Prohibited actions on Clean Ocean App

It is strictly prohibited to do any of the following with- or on the App:

publishing obscene, offensive, violent, defamatory, discriminatory, racist, chauvinist material;

publishing of advertising or promotional materials or other forms of marketing;

publishing or disseminating of sexually explicit materials;

sending links to websites with adult content;

transmission of viruses, worms or programs designed to destroy or harm operating systems;

upload, post or otherwise transmit material like request of other Clean Ocean App user's account password;

uploading, posting, disseminating or transmitting of content which infringes the rights of third parties;

promoting information that user knows to be false or promoting illegal activities or abusive, obscene, threatening, libelous material;

promoting or providing information about the development of illegal activities,

publishing material protected by copyright, for which there is no permission for publication and dissemination.

COS may, however is not obliged to, delete and remove materials that feature or may feature prohibited content and may at any time suspend or block the user's account.

COS is not responsible for the reports made on the Clean Ocean App by its uses and does not monitor accuracy: COS is not responsible or liable for the content published. The users are solely liable for the compliance of user-provided content to these Terms and Conditions, third party rights and applicable law.

Use of content

Content means all user related information contained in the App as text, data, software and images. The content of the website (opened with external browser) and the COS App cannot be taken, distributed, sold or resold without the written consent of COS. Unauthorized use of the information, brands or any users’ data on LDI App is strictly prohibited. In case of violation of these provisions, COS reserves the right to seek legal support for violation of its rights and undertake action against violators.

These Terms and Conditions do not grant the user any rights to use the Clean Ocean App, except the right to use the App for its intended purposes.

Users grant to COS a non-exclusive, free, worldwide license to use the content that users post on the Clean Ocean App.

Users posting any pictures on Clean Ocean App or website should ensure that all content is owned by the user or has the right to use it.

Links to other websites

COS is not responsible for any information found by links to other websites which it might share.

Disclaimer

Users understand and agree to the following:

the use of information is at your own risk;

COS does not guarantee that: Clean Ocean Apps will be uninterrupted, timely, secure or error free;

Information published on the Clean Ocean App might be incorrect or inaccurate;

written information obtained through Clean Ocean App will not create any liability against the Clean Ocean;

Liability

To the maximum extent permitted by law, COS shall not be liable for any damages resulting from the use of the Clean Ocean App.

Changes in the Clean Ocean App

COS may at any time make changes to the Clean Ocean App.

Governing law and dispute resolution

The laws of Switzerland shall apply to the implementation of these Terms and Conditions.

All disputes arising out of or relating to these Terms and Conditions, or the breach, termination or invalidity hereof, which the parties fail to resolve by means of negotiations, shall be referred to the Court of Thun. Swiss Law applies.

Clean Ocean Society ("us", "we", or "our") operates the Clean Ocean App mobile application (the "Clean Ocean App").

We use "cookies" to collect information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Clean Ocean App.

Clean Ocean App Providers

We may employ third party companies and individuals to facilitate our Clean Ocean App, to provide the Clean Ocean App on our behalf, to perform Clean Ocean App-related services or to assist us in analyzing how our Clean Ocean App is used.

These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

We will disclose your Personal Information where required to do so by law or subpoena or if we believe that such action is necessary to comply with the law and the reasonable requests of law enforcement or to protect the security or integrity of our Clean Ocean App.

Our Clean Ocean App may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over, and assume no responsibility for the content, privacy policies or practices of any third party sites or Clean Ocean Apps.

Children's Privacy

Our Clean Ocean App does not address anyone under the age of 13 ("Children").

We do not knowingly collect personally identifiable information from children under 13. If you are a parent or guardian and you are aware that your Children has provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from a child under age 13 without verification of parental consent, we take steps to remove that information from our servers.

Changes To This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.
